You will be asked to fill out the form at the latest on the first day of the tour prior to the departure. If you wish to fill it out before your arrival date you are welcome to do so and mail it to us when you have got your booking confirmed.

LIABILITY WAIVER / RELEASE FORM

Sea kayaking is often classified as a “soft adventure” but there is always a risk involved. You may get seriously injured and in the worst scenario you will die. The hazards are difficult to recognize due to the natural conditions of the sea in tropical regions. Even kayaking in shallow water within the lagoon carries a risk, although kayaking on the open ocean requires more skill and is generally riskier. Shark attacks are not common in the waters around Samoa but anyone kayaking beyond the reef should be aware of that there is a risk of being attacked. 

It is important for your safety that you are aware of the risk involved with kayaking in Samoa and that, when you are on the tour, you must pay attention to all instructions and directives given by your guide. Of the same reason it is important that you let us know if you have any disabilities or health problems that may affect your safety and performance during the tour. If you easily get seasick you should avoid kayaking on open ocean.

  • You are advised by Island Explorer Ltd. to have sufficient medical insurance, travel insurance and life assurance covers.

  • The management and staff of Island Explorer Ltd. AGREES to take all care but accepts no responsibility for loss of life, personal injury, loss of personal effects, disruption to itineraries, natural disasters and all forms of civil disturbance including war.

  • I/we AGREE to declare the status of my/our personal health and level of fitness before the commencement of the tour as well as during the tour.

  • I/we AGREE to accept all responsibility for my/our personal health.

  • I/we UNDERSTAND that Island Explorer Ltd. must reserve the right to withdraw or refuse any service to any client at any time and AGREE to follow all instructions offered by the management and staff of Island Explorer Ltd.

  • I/we UNDERSTAND that clients under the age of 21 years shall have this release form signed on their behalf by a parent, guardian or group leader who therefore assumes all risks and responsibilities for any loss or injury to those persons.

  • I/we DECLARE that this Release Form is binding upon me/our, my/our heirs, executors, administrators and assigns, and AGREE to exempt and relieve Island Explorer Ltd., its management and staff from liability for personal injury, property damage, loss of personal effects or wrongful death caused by negligence.

  • I/we hereby DECLARE that I/we are holding a valid insurance that covers personal injury, loss of life, damage of property and loss of personal effects.

  • I/we hereby AGREE to the conditions of the above Release Form and AGREE to accept the risks involved in places without nearby medical facilities, and other circumstances beyond the control of Island Explorer Ltd., its agents or servants.

  • I/we ACKNOWLEDGE that I/we have read and understood the contents of this Release Form, UNDERSTAND the legal consequences of signing this instrument and appreciate that these guidelines are designed to help ensure that my/our visit to Samoa is a safe, meaningful and enjoyable visit.
